CHICAGO — A laborers' union is suing ECW Construction, a contractor, citing alleged breach of contract.
The Construction and General Laborers' District Council of Chicago and Vicinity and its benefit funds, as well as Catherine Wenskus, as assistant administrator for the funds, filed a complaint on May 17 in U.S. District Court for the Northern District of Illinois against ECW Construction, alleging that it failed to remit its employees' contributions to the union funds.
According to the complaint, the plaintiffs allege their organization was damaged due to the unpaid contributions. The plaintiffs hold ECW Construction responsible because the defendant allegedly breached its contractual agreement under the applicable CBA by failing to remit employees' monthly contributions.
The plaintiffs seek amounts due and owed, court costs, liquidated damages, audit costs and any further relief this court grants. They are represented by Amy Carollo of Laborers' Pension and Welfare Funds in Chicago.
