CHICAGO — A Yorkville couple has filed a class-action lawsuit against Premier Dermatology and Forefront Dermatology, alleging violation of telephone harassment statutes.
Kimberly Smith and Steve Smith filed a complaint on behalf of all others similarly situated on May 17 in U.S. District Court for the Northern District of Illinois against the defendants alleging they sent unwanted text messages to the plaintiffs.
According to the complaint, the plaintiffs allege that, in 2016, they received unwanted text messages pitching dermatology products and services. The plaintiffs hold Premier Dermatology and Forefront Dermatology responsible because the defendants allegedly continued to send unsolicited text messages to the plaintiffs despite their requests to stop, not allowing them to opt out of receiving the notifications, for which they may have been charged.
The plaintiffs request a trial by jury and seek $500 in statutory damages, injunctive relief, $1,500 in treble damages and any further relief this court grants. They are represented by Jeffrey M. Salas of Salas Wang LLC in Chicago.
