CHICAGO — Two Illinois corporations are suing doctor Kenji Oyasu and ModernMed Recovery LLC for alleged breach of contract and duty.
PBJ Capital Partners LLC and Kenneth P. Wind M.D. P.C., which does business as Brightside Clinics, filed a complaint on July 19 in Cook County Circuit Court, alleging the defendants competed against them, which allegedly is a breach of their contractual agreement.
According to the complaint, the plaintiffs allege they sustained damages to their business from having patients solicited away from them. The plaintiffs hold the defendants responsible for allegedly leaving employment with the plaintiffs while allegedly plotting to take patients and form a business that directly competes with them.
The plaintiffs seek an injunction against the defendants, compensatory damages of at least $100,000, an order compelling the defendant to return all confidential patient information and business information, punitive damages, court costs and any further relief this court grants. They are represented by William K. Kane and Shawn D. Fabian of Sheppard, Mullin, Richter & Hampton LLP in Chicago.
