City of Chicago, bar owners, police officer accused in woman's death

CHICAGO — An estate representative is suing the city of Chicago; Chicago Police Officer Danielle Deering; Pappas Restaurants Inc., Jack Desmond's Irish Pub Inc., and Alsip Restaurant and Lounge Inc., all three of which do business as Bar 122; and VPEN Inc., which does business as 115 Bourbon Street, alleging they should be held responsible for the death of a woman who police say killed herself using an off-duty police officer's service weapon.

Francisca Falcon, representative of the estate of Ruby Falcon, filed a complaint on July 23 in Cook County Circuit Court, alleging the defendants served Deering alcohol while she was carrying her service weapon, allowing her to become intoxicated.

According to the complaint, the plaintiff alleges Falcon died from a gunshot wound to the head from Deering's weapon. According to the complaint, Deering told police she and Falcon had traveled to Deering's home, at which time she had placed her weapon down in her kitchen. The lawsuit says she told police Falcon had then used the weapon to take her own life while Deering was in another room. The plaintiff holds the defendants responsible for Deering's alleged failure to properly secure her service weapon.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount greater than $50,000 plus interest and any further relief this court grants. She is represented by Martin Gould and Nicolette Ward of Romanucci & Blandin LLC in Chicago.
