Rust Oleum Corporation, others accused of product liability

CHICAGO — A married couple is suing Rust Oleum Corporation, Menard Inc. and Rust-Oleum Sales Company Inc. for alleged liability, negligence and product liability.

Raul and Joanne Banos filed a complaint on Aug. 21 in Cook County Circuit Court, alleging the defendants manufactured a dangerous product that can cause severe respiratory problems.

According to the complaint, the plaintiffs allege Raul Banos sustained serious respiratory problems in 2015, allegedly as a result of prolonged exposure to the StripFast Power Stripper paint and varnish stripper, which allegedly contains methylene chloride. The plaintiffs hold the defendants responsible for allegedly failing to warn of the health hazard of being exposed to the methylene chloride that allegedly was present in their product.

The plaintiffs seek judgment against the defendants in an amount greater than $50,000. They are represented by David J. Kupets of Law Offices of Kupets & DeCaro P.C. in Chicago.
