CHICAGO — A worker is suing Walsh/II In One Joint Venture III, Walsh Construction Company, Chicago Transit Authority and Atlas Crane Service Inc. for alleged liability and negligence.
James P. Mitchell filed a complaint on Sept. 21 in Cook County Circuit Court, alleging the defendants allowed an elevated train to pass through the work site and cause a hazardous condition.
According to the complaint, the plaintiff alleges he sustained serious physical injuries on Feb. 7 when a crane that was lifting steel touched the cable, causing it to spark and explode. The plaintiff holds the defendants responsible for allegedly allowing trains to enter the work area in close proximity to the live tracks.
The plaintiff seeks judgment against the defendants in an amount sufficient to satisfy the jurisdictional limits of this court, court costs and any further relief this court grants. He is represented by Marc A. Taxman and James P. Lynch of Taxman, Pollock, Murray & Bekkerman LLC in Chicago.
