Metra allegedly failed to prevent passenger from head-butting employee

CHICAGO — A Metra employee is suing Metra and a passenger for alleged liability and negligence.

John W. Smak filed a complaint on Sept. 22 in Cook County Circuit Court, alleging Metra failed to provide a reasonably safe work place.

According to the complaint, the plaintiff alleges the passenger grabbed and head-butted him on July 6, 2015, while attempting to open the coach car doors. The plaintiff holds the defendants responsible for allegedly failing to provide adequate security.

The plaintiff seeks judgment against the defendants in an amount greater than $50,000 plus court costs. He is represented by Scott C. Sands of Sands & Associates in Chicago.
