American Alliance Casualty alleges teen driver not covered under family plan, no payment for car vs house

CHICAGO — An insurance company is suing Maria Ruiz, Hector Cortez, Jenny Hua and Lan Cencil for alleged breach of contract.

American Alliance Casualty Company filed a complaint on Oct. 10 in Cook County Circuit Court, alleging the defendants failed to disclose that Cortez was a household resident driver over the age of 15 in their application. Cortez was driving a car that crashed into a house in Cicero in 2016 owned by Hua and Cencil.

The plaintiff seeks order that the policy was rescinded and was null and void due to the alleged misrepresentation during the application process, declare that the plaintiff owes no duty to defend or indemnify Ruiz or Cortez, order that neither Hua nor Cench are entitled to recover monies or obtain any coverage whatsoever under the policy and any further relief this court grants. The plaintiff is represented by Alexander I. Arezina Esq., of Oakbrook Terrace.
