Chicago's Best Inc. allegedly failed to pay proper wages

CHICAGO — Two employees have filed a class action suit against Chicago's Best Inc. and Martin Flores for alleged unpaid wages, violation of minimum wage laws and violation of workers' compensation acts.

Darwin Serrano and Danny Truong filed a complaint on Oct. 6 in Cook County Circuit Court, alleging the defendants failed to adequately compensate them for their work.

According to the complaint, the plaintiffs allege they worked as delivery drivers and worked for more than 40 hours per week, but were not paid overtime wages or minimum wage. 

The plaintiffs request a trial by jury and seek judgment against the defendants in an unspecified amount for actual damages, unpaid wages, plus punitive damages and attorney fees. They are also asked the court to order the defendants to pay $5,000 for each allegedly incorrect 1099 form filed with the Internal Revenue Service. They are represented by Carlos G. Becerra of Becerra Law Group LLC in Chicago.
