CHICAGO — Two people have filed a class action lawsuit against Healthcare Services Group Inc. for alleged invasion of privacy and violation of state law.
Earrious Moore and Ebony Gilmore filed a complaint on Oct. 11 in Cook County Circuit Court, alleging the defendant collected and stored their biometric information without consent, because their employer required them to scan their fingerprints into a company database to be used to verify their identity each time they punch in and out of work shifts.
According to the complaint, the plaintiffs allege that they suffered damages as a result of their biometric information being recorded without their consent every time they clock in and out from work. The plaintiffs hold the defendant responsible for allegedly failing to adequately explain to them why their biometric information has to be recorded and stored or obtain their written consent to scan and store their fingerprints.
The plaintiffs request a trial by jury and seek statutory damages, injunctive and equitable relief, court costs, interest and any further relief this court grants.
