CHICAGO — A woman has filed a class action lawsuit against Presence Health Network, alleging the operator of a dozen hospitals violated a state privacy law when it scanned and collected her fingerprints, as well as those of many other workers, for use with its employee time clocks.
Nichole Holm filed a complaint on Dec. 12 in Cook County Circuit Court, alleging that the defendants collected her biometric information without consent, allegedly violating the Illinois Biometric Information Privacy Act.
According to the complaint, the plaintiff alleges that her fingerprints were collected and stored without consent every time she clocked in for work. The plaintiff holds the defendants responsible for allegedly failing to give her proper notice as to why her biometric information was being collected and for how long the information would be stored.
The plaintiff seeks injunctive and equitable relief, statutory damages of $5,000, statutory damages of $1,000, court costs and any further relief this court grants. She is represented by John J. Driscoll, Christopher J. Quinn and Gregory J. Pals of The Driscoll Firm P.C. in St. Louis, Mo.
