CHICAGO — An Illinois consumer has filed a class-action lawsuit against Nordic Naturals Inc. and Nordic Naturals Mfg. Inc., citing alleged fraud, negligence, negligent misrepresentation, unfair competition, unjust enrichment and violation of federal law.
Lyubov Elikman filed a complaint on behalf of a class of similarly situated individuals Feb. 21 in the Cook County Circuit Court, alleging Nordic Naturals made false claims regarding its product, misleading her and others to buy a product that was advertised as having 15 billion colony forming units of probiotics per capsule, while the actual number of units was fewer than claimed.
The plaintiff said she holds Nordic Naturals responsible because the defendants allegedly knew each serving of Nordic Flora Probiotic Women product only has 581,000 units, not the advertised 15 billion.
The plaintiff requests a trial by jury; and seeks actual and compensatory damages, all funds unjustly retained, injunctive relief, court costs and any further relief the court grants. She is represented by Yevgeniy "Eugene" I. Turin Sr. of Eugene Turin Law in Deerfield.
