Elite Staffing Inc., Visual Pak Company allegedly collected fingerprints without consent

CHICAGO — A worker has filed a class action lawsuit against Elite Staffing Inc. and Visual Pak Company for alleged invasion of privacy and violation of state law, for allegedly collecting employee fingerprints for use with a wage and hour timekeeping system, without first providing employees with documents and information required by Illinois state law.

Luis Sanchez filed a complaint on Feb. 27 in Cook County Circuit Court, alleging the defendants collected and stored his biometric data without consent, in vilation of the Illinois Biometric Information Privacy Act. The plaintiff holds the defendants responsible for allegedly failing to inform him why his fingerprint was being collected and for how long they intended to keep the information.

The plaintiff requests a trial by jury and seeks statutory damages of $5,000, statutory damages of $1,000 for each negligent violation, injunctive and other equitable relief, court costs, interest and any further relief this court grants.
