Tenants class action claims B&A Associates, Elm Apartments didn't provide copy of Chicago ordinance

CHICAGO — Two tenants have filed a class action suit against B&A Associates LLC and Elm Apartments LLC for alleged breach of contract.

Erica Schwartz & Matthew Bailey filed the complaint on March 28 in Cook County Circuit Court, alleging the defendants failed to provide them with a summary of Chicago's Residential Landlord and Tenant Ordinance (RLTO) along with their rental agreement, as required by the ordinance.

The plaintiffs allege the defendants provided their own version of a RLTO summary to them, which allegedly was not from the city of Chicago.

The plaintiffs seek $100 for all class members, plus attorney fees, court costs and any further relief this court grants. They are represented by Aaron Krolik of Aaron Krolik Law Office P.A. in Chicago and Mark Silverman of Mark Silverman Law Office Ltd. in Chicago.
