Spencer Leak Funeral Home, Chicago sued after woman trips, is injured by dilapidated fence

CHICAGO — A couple is suing Spencer Leak & Sons Funeral Home Ltd. and the city of Chicago for alleged loss of consortium and negligence.

Denise and Chedrick Square filed a complaint on April 12 in Cook County Circuit Court, alleging the defendants failed to follow applicable safety guidelines and regulations.

According to the complaint, the plaintiffs allege Denise Square suffered severe injuries on Aug. 16, 2013, including bruises, contusions and lacerations, while her husband allegedly suffered the loss of care, services, consortium and companionship of his wife. Denise Square's injuries allegedly were caused by a fence that the defendants allegedly had allowed to fall into disrepair, which allegedly resulted in her tripping over a bent and deteriorated support post.

The plaintiffs hold the defendants responsible for allegedly failing to warn guests of the hazard posed by the deteriorated fence and for allegedly failing to repair, remove or replace the fence after it had deteriorated.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount greater than $50,000, plus the costs of the suit. They are represented by Terry M. Lachcik of the Law Office of Daniel E. Goodman LLC in Rosemont.
