Illinois AG, Shirley Ryan AbilityLab secure consent decree to end action over environmental regulations

CHICAGO — Illinois Attorney General Lisa Madigan's office, for the Illinois Environmental Protection Agency, has settled a complaint againsy Shirley Ryan AbilityLab on behalf of Illinois residents for the company's alleged violation of the state's environmental regulations.

Madigan filed the complaint April 18 in Cook County Circuit Court, alleging the defendant violated Illinois environmental regulations when it allegedly failed to timely file a complete annual emissions report.

The case was dismissed on April 19 under a consent decree agreed to by the defendant and the Illinois EPA before the lawsuit was filed as a legal formality.

Absent the decree, Madigan's office and the Illinois EPA would have requested a trial by jury and a judgment against the defendant for civil penalties of $50,000 for each violation and an additional civil penalty of $10,000 for each day of violation, plus all costs, attorney's fees, expert witness and consultant fees and any other relief the court deems just. The state was represented by Elizabeth Wallace and Daniel Robertson of the Illinois Attorney General's Office's Environmental Bureau in Chicago.
