Tenant Deming Place sues association board for breach of fiduciary duty

CHICAGO — A tenant is suing the board of managers of the 1201-1025 Madison Condominium Association for alleged breach of duty.

Deming Place LLC filed a complaint on April 23 in Cook County Circuit Court, alleging it suffered damages because the defendants burdened it with impossible conditions in retaliation for its requests to examine records and a renovation permit. 

Specifically, Deming Place said the defendants denied its request to examine the association's records, failing to hold open meetings and propose budgets, refusing to reverse the unlawful distribution of reserves at the plaintiff's expense and imposing unjustified conditions on the plaintiff to renovate its unit.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages. The plaintiff also seeks an order that the defendants turn over the requested documents, seeks recovery of disbursed reserves and seeks an order that the defendants cease interfering with the plaintiff's renovation, as well as any other relief deemed just. The plaintiff is represented by Noah Weininger of Johnson, Blumberg & Associates LLC in Chicago.
