Chicago Board of Education, others allegedly failed to prevent sexual harassment by janitor contractor

CHICAGO — A mother and her minor child are suing Aramark Education K-12, Vargas Group Inc., the Chicago Board of Education and an employee of Vargas for alleged harassment and negligence.

Jane Doe, mother of Mary Doe, filed a complaint on May 22 in the Cook County Circuit Court, alleging the defendants breached their duties to manage, supervise, monitor and oversee Arias, an employee of the Vargas Group, a third-party subcontractor who allegedly was hired to perform janitorial services.

According to the complaint, Jane Doe alleges the Vargas employee sexually harassed her minor child. As a result, the plaintiff's daughter allegedly has experienced psychological trauma, including sadness, distrust and thoughts of suicide. The plaintiff holds the defendants responsible for allegedly failing to prevent sexual harassment and abuse.

The plaintiff requests a trial by jury; and seeks actual damages, injunctive relief, punitive damages, attorney's fees, costs and any other relief that the court deems proper. She is represented by Zneimer & Zneimer PC in Chicago.
