Amtrak, others allegedly failed to prevent man from being hit and killed by train in Riverdale

CHICAGO — An estate administrator is suing Amtrak, Pat Martin, Canadian National Railway Corp. and the Village of Riverdale for alleged negligence.

Muneera Choice, special administrator of the estate of Tyrese Choice, filed a complaint on May 24 in the Cook County Circuit Court, alleging that the defendants failed to avoid harming individuals who are on their property.

According to the complaint, the plaintiff alleges that Tyrese Choice was struck and killed by an Amtrak passenger train on May 25, 2017, in Riverdale. The plaintiff holds the defendants responsible for allegedly failing to adequately warn Tyrese Choice about the dangers of being on their property. The lawsuit asserts Choice was lawfully on the property at the time of the incident.

The plaintiff requests a trial by jury and seeks judgment in an amount that exceeds $50,000, plus the costs of the suit. She is represented by Jon C. Papin of the Vrdolyak Law Group LLC in Chicago.
