Mishle Home Care Franchising, others allegedly failed to prevent woman from fracturing hip and arm

CHICAGO — An estate executor is suing Mishle Home Care Franchising Inc. and Mishle Home Health Care Inc. for alleged breach of duty and negligence.

Mark Mytnik, independent executor of the estate of Rita M. Mytnik, filed a complaint on May 24 in Cook County Circuit Court, alleging the defendants violated the Illinois Wrongful Death Act.

According to the complaint, the plaintiff alleges Rita Mytnik suffered pain and physical injuries after she allegedly fell and fractured her arm and hip. The plaintiff holds the defendants responsible for allegedly failing to prevent Rita M. Mytnik from falling and to recognize her injuries.

The plaintiff requests a trial by jury and seeks judgment in an amount that exceeds $30,000, plus the costs of this action. He is represented by Adam J. Zayed and Evan S. Sloan of Zayed Law Offices in Joliet.
