Woman says property owners allowed debris to build up on sidewalk, causing slip and fall

CHICAGO — A woman is suing four property owners, claiming they didn't do enough to prevent mud and debris from their property from making a public sidewalk hazardous.

Debora Giles filed a complaint May 31 in Cook County Circuit Court against Lorayne Roberts, Martin Roberts, Joseph Kelly and Melissa Kelly, alleging she was walking on the public sidewalk that runs along the defendants' property on June 10, 2016, when she slipped and fell because of the alleged accumulation of mud, water, sludge and debris settled on the sidewalk in front of the defendants' property.

Giles claims the defendants caused and allowed their pump or gutter downspout to be extended and set in a direction that caused the water to run down onto the public sidewalk. 

The plaintiff said she holds the defendants responsible for the incident because they allegedly failed to prevent, water, mud, sludge and other debris from draining from the gutters toward the sidewalk and failed to warn the public of a dangerous condition.

The plaintiff requests a trial by jury and seeks judgment in an amount greater than $50,000, plus costs. She is represented by Howard M. Zavell and Brian J. Kaplan of Dickler, Kahn, Slowikowski & Zavell, Ltd. in Arlington Heights.
