MyLife accused of using members' identities for advertising purposes

CHICAGO — A consumer has filed a class action lawsuit against California-based MyLife.com Inc., citing alleged invasion of privacy.

Lead plaintiff Maribel Deyerler filed a complaint June 4 in Cook County Circuit Court, alleging the defendant violated the Illinois Right of Publicity Act by using individual members' names and identities in advertisements for its own commercial benefit.

According to the complaint, Deyerler discovered in 2018 the defendant was using her name, birthday, the name of the city where she lived and the identity of her relatives in an advertisement on the MyLife website in order to sell products and services.

The class members claim they never gave MyLife written permission to use any attribute of their identities in any advertisement or for any commercial purposes. 

As a result, Deyerler claims the unauthorized use of her identity has caused emotional distress. 

The plaintiff requests a trial by jury and seeks injunctive and other equitable relief, award of actual and punitive damages, litigation expenses, attorney's fees, pre-judgment and post-judgment interest and other relief the court deems just. She is represented by William H. Beaumont and Emily A. Westermeier of Beaumont Costales LLC in Chicago.
