Employees sue Saint Anthony Hospital, ADP over fingerprint scans

CHICAGO — A class action lawsuit has been filed by employees of Saint Anthony Hospital against the hospital and ADP LLC, citing alleged violation of the Illinois Biometric Information Privacy Act (BIPA).

Lead plaintiff Fonda Peaks-Smith filed a complaint June 5 in Cook County Circuit Court, alleging Saint Anthony Hospital and ADP failed to inform employees that their fingerprint scans, which were used to operate the employee punch clocks to track hours worked, were being collected, stored and disseminated, and failed to provide a schedule for permanent destruction of employees' biometric data.

The plaintiff requests a trial by jury and seeks a judgment against defendants, certification as a class, declaratory relief, statutory damages, injunctive and equitable relief, attorney's fees, costs, litigation expenses, interest and further relief as the court deems just.
