CHICAGO — A consumer is suing H. Matthew Chambers, Curtiss Motorcycle Co.and Confederate Motors Inc., citing alleged breach of contract, conversion and fraud.
Justin Singer filed a complaint June 1 in Cook County Circuit Court, alleging that the defendants breached their duties of good faith and fair dealing by refusing to return a $5,000 deposit the plaintiff put down toward the purchase of a limited edition X132 Hellcat Combat motorcycle.
According to the complaint, the defendants sold the motorcycle in question to another customer for more money, allegedly taking advantage of the increased market value that was well above than what the plaintiff agreed to pay.
The plaintiff requests a trial by jury and seeks a judgment against defendant in the amount of $40,000 plus interest, costs and further relief as the court deems just. He is represented by Adam M. Berger and Brian R. Grimm of Kelley Kronenberg in Chicago.
