Representative blames Lakeview Rehabilitation and Nursing for patient fall

CHICAGO — A woman's representative is suing Lakeview Rehabilitation and Nursing Center LLC and administrator Michael Elkes, citing alleged negligence and violation of the Nursing Home Care Act.

Raul Rivera, who has been appointed power of attorney for Ana Rivera, filed a complaint June 11 in Cook County Circuit Court, alleging the defendants failed to provide services that met professional standards of quality when Ana Rivera fell at the facility on Feb. 1, 2017.

According to the complaint, Ana Rivera was subjected to pain and suffering, disability, disfigurement and deterioration of her physical and mental condition as a result of the fall and incurred medical expenses.

Raul Rivera said the defendants are responsible because they allegedly failed to provide properly supervised nursing and personal care, failed to oversee the comprehensive assessment of the resident and failed to implement an up-to-date resident care plan and effective precautions to prevent falls.

The plaintiff requests a trial by jury and seeks a judgment against the defendants for damages greater than $50,000, as well as attorney's fees and costs. He is represented by Naderh Elrabadi of Elrabadi Law in Chicago.
