CHICAGO — A medical equipment company is suing Acuity Hospital of South Texas LLC, citing alleged breach of contract.
Medline Industries Inc. filed a complaint June 8 in Cook County Circuit Court, alleging that Acuity breached its duty of good faith and fair dealing.
According to the complaint, Medline has suffered financial injury because the defendant allegedly accepted and kept goods supplied by the plaintiff without paying for them.
Specifically, Medline said Acuity refused to pay $107,357.25 plus interest for all past due amounts in accordance with an agreement between the parties and forced the plaintiff to hire an attorney to protect its interest.
The plaintiff requests a trial by jury and seeks a judgment against defendant in the amount of $107,357, plus interest, attorney's fees and costs. It is represented by Michael Baim of The CKB Firm in Chicago.
