Patient accuses Davol, CR Bard of selling defective hernia patch

CHICAGO — An Illinois resident is suing Davol Inc. and CR Bard Inc., citing alleged negligence and strict liability.

George Elliot filed a complaint June 29 in Cook County Circuit Court, alleging the defendants failed to provide products that met the professional standards of quality.

According to the complaint, Eliot needed an additional surgery on June 9, 2016 after he allegedly developed severe and recurring abdominal pain, bleeding, redness and swelling around a surgical incision as a result of hernia patch manufactured and distributed by the defendants. 

Eliot said tthe defendants allegedly failed to warn him and his doctors about the product's risks and failed to conduct sufficient studies to determine if the patch was safe for its intended use.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount that adequately compensates for his losses. He is represented by Allen Schwartz of Kravolec, Jambois & Schwartz in Chicago and Robert Salim and Tenia Griffin of Salim-Beasley LLC in Natchitoches, Louisiana.
