Child and parents claim My Dentist, Dr. Yu didn't properly install girl's braces

Medical malpractice 06

CHICAGO — A child, through her parents, is suing a dentist, citing alleged professional negligence.

The girl, through her parents Juan Martinez and Eva Martinez, filed a complaint June 29 in Cook County Circuit Court against David Yu, and My Dentist PC, claiming that the defendant failed to properly examine, diagnose and treat her in accordance with common practices.

According to the complaint, in July 2012, Yu provided orthodontic and teeth-straightening services to the girl. However, her parents claim Yu did not properly place her braces, causing her teeth to be improperly positioned and resulting in mandibular condyle and difficulty chewing.

The plaintiffs request a trial by jury and seek a judgment greater than $50,000, plus costs and other relief as the court deems just. They are represented by attorney Richard Kates in Chicago.
