Estate administrator blames Berkshire Nursing for patient's death

CHICAGO — An independent estate executor is suing Berkshire Nursing & Rehab Center LLC, which does business as Aperion Care Forest Park, as well as Aperion Care Inc. and a nurse, citing alleged negligence.

Desiree Sharif filed a complaint June 27 in Cook County Circuit Court on behalf of the estate of Samuel Bennett Jr., alleging the defendants failed to provide services that met professional standards of quality.

According to the complaint, Bennett died on Sept. 15, 2016, from septic shock and MRSA infection, allegedly as a result of the defendants' failure to provide adequate care, treatment and monitoring of his condition. 

Sharif said the defendants should be held responsible because they allegedly failed to notify Bennett's doctor of changes in his condition, failed to properly assess and monitor his condition and failed to timely transfer him to the hospital.

The plaintiff requests a trial by jury and seeks a judgment against defendant for compensatory damages, costs and attorney's fees. She is represented by Jacqueline Kanter of Kralovec, Jambois & Schwartz in Chicago.
