Patient claims Van Dam Dermatology failed to inform her of Botox risks

CHICAGO — A patient is suing Van Dam Dermatology and Laser Center, citing alleged medical malpractice.

Jeanette Battista filed a complaint July 2 in Cook County Circuit Court gainst Dr. David Van Dam, who does business as Van Dam Dermatology and Laser Center, and affiliated defendants, alleging that they failed to adequately inform her about the risks of Botox injections.

According to the complaint, Battista went to the defendant's facility on Sept. 10, 2012 to receive Botox treatment and to have a consultation regarding treatment of spider veins. The plaintiff claims she was injected with at least 113 units of Botox in at least 31 injection sites over her head, face and neck. 

After the operation, Battista said she had difficulty swallowing and severe pain throughout her body and suffered an acute severe reaction to the Botox. 

Battista said the defendants allegedly failed to inform her of the serious side effects and potential complications from Botox injections and failed to warn her that Botox can cause life-threatening injuries.

The plaintiff requests a trial by jury and seeks a judgment greater than $50,000 and other relief the court deems just. She is represented by Bary Gassman of Gassman Legal PC in Chicago.
