CHICAGO — A surviving son and estate administrator is suing a nursing care facility, citing alleged negligent supervision.
Joseph Balogh, as administrator of the estate of Elisabeta Balog, filed a complaint July 18 in Cook County Circuit Court against Lexington Health Care Center of Wheeling for alleged violation of the Nursing Home Care Act and Survival Act.
According to the complaint, Elisabeta Balog was admitted to the defendants' facility on Aug. 7, 2016, because she was in need of skilled nursing home care.
However, Joseph Balogh claims, during his mother's residency at the facility, she suffered a fracture to her right hip and other physical injuries and required hospitalization. Elisabeta Balog died Aug. 8, 2016.
Joseph Balogh said the defendants should be held responsible because they allegedly failed to provide the recommended care and services to maintain the resident's highest possible level of physical, mental and psychological well-being.
The plaintiff requests a trial by jury and seeks a judgment greater than $50,000, plus costs of the action. He is represented by John Cichon of Polansky & Cichon CHTD in Chicago.
