CHICAGO — An estate executor is suing Pleasant View Luther Home, Lutheran Home For the Aged Inc. and Director of Nursing Suzann Armstrong, citing alleged violations of the Nursing Home Care Act, the Illinois Survival Act and the Wrongful Death Act.

Michael Wasilewski filed a complaint on behalf of the estate of Edmund D. Wasilewski July 18 in Cook County Circuit Court, alleging, between Sept. 22-Sept. 27, 2017,  Edmund Wasilewski fell while he was a resident at the defendants' facility. The plaintiff said the fall allegedly resulted in a chest injury that led to hemopneumothorax and contributed to Wasilewski's death.

The plaintiff said the defendants should be held responsible because they allegedly did not have staff in position to prevent Wasilewski from falling and they failed to provide necessary medical supplies, such as bed and chair alarms, to prevent falls.

The plaintiff seeks an amount greater than $50,000. He is represented by Michael Bonamarte IV and Michael Shanahan of Levin & Perconti in Chicago.
