Estate administrator blames Villa at Evergreen Park for resident's death

CHICAGO — An estate administrator is suing The Villa  at Evergreen Park and South Suburban Rehab Center, citing alleged negligent supervision.

Johnny Gaddy, as independent administrator of the estate of Mildred H. Duncan, filed a complaint July 17 in Cook County Circuit Court, claiming the defendants violated the Illinois Nursing Home Care Act.

According to the complaint, Duncan was admitted to the defendants' facility on July 19, 2016, and had a high risk of falling.

Gaddy claims Duncan fell while she was residing at the facility, resulting in injuries that required hospitalization and a deterioration in her physical and mental condition. 

The plaintiff said the defendants should be held responsible because they allegedly failed to provide properly supervised nursing and personal care to meet every resident's needs.

The plaintiff requests a trial by jury and seeks compensation greater than $50,000. He is represented by Matthew Henry of the Law Offices of Steven J. Malman & Associates PC in Chicago.
