CHICAGO — An estate administrator is suing Applewood Rehabilitation Center LLC, citing alleged negligent supervision.

Velma Hailey, independent administrator of the estate of Annie Smith, filed a complaint July 17 in Cook County Circuit Court, alleging the defendant failed to comply with regulations of the Illinois Department of Public Health and the requirements of the Nursing Home Act.

According to the complaint, Smith became a resident of the defendant's facility on May 17, 2013, for daily supervision, as she was bedridden and at a high risk for developing pressure ulcers.

However, Hailey claims Smith was not properly treated and her skin continued to break down, resulting in gangrene and pressure ulcers. Annie Smith died on July 23, 2013.

Hailey said the defendant allegedly failed to appropriately treat Smith's pressure ulcer, failed to appropriately document her skin breakdown and gangrene and failed to perform appropriate skin checks.

The plaintiff requests a trial by jury and seeks a judgment greater than $50,000, plus costs and attorney's fees. She is represented by David Petrich of Sandman, Levy and Petrich LLC in Chicago.
