Resident blames Manor Care of Oak Lawn for fracture, complications from fall

CHICAGO — A resident is suing Manor Care of Oak Lawn (East) IL LLC, doing business as Manor Care Health Services - Oak Lawn East, and HCR IV Healthcare LLC, citing alleged negligence and violation of the Illinois Nursing Home Care Act.

Karol Walter filed a complaint Aug. 3 in Cook County Circuit Court, claiming Walter fractured her humerus in a fall on Aug. 16, 2016, requiring surgery, and suffered complications including pulmonary embolism during surgery and pneumonia. She said the fall resulted from the defendants' alleged negligence in the care and treatment of her while she was still a resident of their facility in Oak Lawn City. 

Walter said the defendants allegedly failed to keep accurate records concerning her care and treatment, failed to provide a sufficient nursing staff, failed to properly assess and update her care plan and failed to adequately train employees to prevent falls.

The plaintiff requests a trial by jury and seeks a judgment greater than $50,000, costs of the lawsuit and other relief the court deems just. She is represented by Michael Silverman of Horwitz, Horwitz and Associates Ltd. in Chicago.
