Relatives sue Swedish Covenant, others for fall allegedly suffered by man who left hospital after stroke

CHICAGO — Independent executors are suing medical facilities, citing alleged negligent care and supervision.

Llilliam Alonso and Nilda Alonso filed suit Aug. 13 in Cook County Circuit Court on behalf of the estate of Severino Alonso against Swedish Covenant Hospital; Swedish Covenant Hospital Foundation; Sodexo America, LLC and Sodexo Management, Inc., alleging the defendants breached their duty to supervise plaintiff Severino regularly.

According to the complaint, from Aug. 24-Sept. 13, 2016, Severino Alonso was under the care of defendants' medical facility because he had slurred speech and general confusion as a result of a mild stroke. 

Despite defendants having a strict fall policy, Alonso allegedly was never provided a band that identified he was on fall precautions with multiple reassessments and contrary to its own policy. 

As a result, Alonso allegedly suffered a laceration and hematoma to the back of his head after he had fallen down on the sidewalk with his walker when he exited the hospital alone and unassisted. 

The plaintiffs alleges defendants failed to follow hospital protocols and procedures in place to properly identify Alonso with fall precautions, failed to prevent him from leaving the facility and failed to properly evaluate and re-evaluate the resident.

The plaintiffs request a trial by jury and seek judgment in a fair and just amount, for certain funeral, medical and burial expenses, together with costs of action. They are represented by Tara Devine and Elizabeth Olszewski of Salvi, Schostok & Pritchard, PC in Waukegan.
