Avanti Wellness and Rehabilitation is sued for alleged negligence

CHICAGO — A woman is suing Avanti Wellness and Rehabilitation, a nursing facility, citing alleged negligence in the care of her mother.

Marzena Szal filed a complaint on Aug. 16 in Cook County Circuit Court, alleging the nursing facility breached the professional standard of care and treatment.

The plaintiff alleges her mother, Maria Costazza, while still residing at defendant's long-term nursing care facility located at 6840 West Touhy in Niles, suffered from multiple fall injuries that caused bleeding inside her head. The injuries required hospitalization and surgery, sustained pain and suffering, and deterioration of her physical and mental condition, that contributed to the cause of her death on May 13, 2017, according to the complaint.

The plaintiff holds Avanti Wellness and Rehabilitation responsible because the defendant allegedly failed to provide properly supervised and trained nursing staff, failed to oversee the comprehensive assessment of decedent, and failed to ensure the care environment was free from accident hazards.

The plaintiff requests a trial by jury and seeks judgment against defendant for more than $50,000, plus attorney's fees and costs. She is represented by Kelly Sabo Gaden of The Law Offices of Steven J. Malman in Chicago.
