Long term care facility sued for alleged failure to diagnose embolism

CHICAGO — A surviving heir is suing physicians and a long term care facility, claiming that a patient's embolism was not properly diagnosed, resulting in his death.

Frank DeVincenzo, as independent administrator of the estate of James DeVincenzo, filed a complaint on Aug. 13 in Cook County Circuit Court against doctor Abdul Hamid Shahbain; Paragon Clinical LLC; and Pulmonary Consultants SC, and othrs, for alleged violation of the Illinois Survival Statute by failing to provide proper care to James DeVincenzo.

According to the complaint, between Aug. 17, 2016, and Sept. 2, 2016, DeVincenzo was a resident of the defendants' long term care facility as he underwent an excision of and infected chronic bursa on his left foot, exploration of his left foot and flap repair of his left foot. 

However, after the operation DeVincenzo was assessed as being unable to stand and was chair-bound and immobile, needing another surgery. Furthermore, he began exhibiting respiratory difficulties and oxygen impairement. 

The plaintiff alleged the defendants failed to properly diagnose a pulmonary embolism based on the presenting signs and symptoms, failed to evaluate the reason for his hypoxia and failed to treat the pulmonary emboli.

The plaintiff requests a trial by jury and seeks judgment of at least $50,000. He is represented by Jeffrey E. Martin of Law Offices of Jeffrey E. Martin LLC in Arlington Hts.
