Consumer files class action vs Laser Aesthetic Center over unwanted text message ads

CHICAGO — A consumer has filed a class-action lawsuit against a dermatology center, citing alleged invasion of privacy and negligence.

Olwen Jaffe, individually and on behalf of a class of similarly situated individuals filed a complaint on Aug. 15 Cook County Circuit Court against Laser Aesthetic Center Inc. for alleged violation of the Telephone Consumer Protection Act.

According to the complaint, in an effort to advertise its services, Jaffe claims he and the class of consumers allegedly received unauthorized advertisement text messages to their cellphones.

The plaintiff asserts Laser Aesthetic Center sent texts to people who did not previously provide prior express written consent to receive such messages.

The plaintiff requests a trial by jury and seeks judgment for actual and statutory damages, attorneys' fees, costs, and such other and further relief the Court deems just and equitable. He is represented by David L. Gerbie of McGuire Law, PC in Chicago.
