Village at Victory Lakes sued after resident's death at long-term care facility

CHICAGO — The Village at Victory Lakes is being blamed in the death of a patient in its assisted living unit at the long-term care facility.

An independent executor is suing Franciscan Communities Inc., doing business as The Village at Victory Lakes, doctor Eugene Pomeranets and Family Care of Lake County SC, citing alleged negligence and wrongful death.

Marjorie Nowakowski filed a complaint on Aug. 13 in Cook County Circuit Court alleging Gladys Rose Werner incurred medical expenses, endured pain and suffering, loss of normal life, disfigurement, lost weight, and developed pressure ulcers and infection, prior to her death on March 1, 2017.

The lawsuit claims negligence in the care, treatment and monitoring of Werner. Additionally, her next-of-kin were deprived of her society, love, affection, companionship and support. 

The plaintiff alleges the defendants discharged Werner to an assisted living unit instead of a skilled nursing unit, and changed her dietary restrictions that caused her to lose weight.

The plaintiff requests a trial by jury and seeks judgment against defendant for more than $50,000, plus costs of lawsuit. She is represented by Brian K. Hetzer of Karlin, Fleisher & Falkenberg LLC in Chicago.
