CHICAGO — Mt. Carmel Missionary Baptist Church is suing a community action agency, citing alleged breach of contract.
Mt. Carmel Missionary Baptist Church filed a complaint on Aug. 24 in Cook County Circuit Court against Community and Economic Development Association (CEDA) of Cook County, Inc., alleging the defendant breached the terms of an agreement by failing to comply with the policies and procedures in conducting an appeal hearing.
According to the complaint, Mt. Carmel has served as a site intake partner for CEDA since 1999. However, on April 6, 2018, Mt. Carmel received a site suspension notice from defendant informing them of an immediate site suspension through Spring 2019.
Plaintiff claims, despite sending written request for a formal appeal hearing pursuant to the parties Partner Site Agreement, the organization allegedly did not receive a response for three months and just received a letter indicating that CEDA had made the decision to uphold plaintiff's site suspension.
The plaintiff alleges CEDA of Cook County denied Mt. Carmel's right to due process and continues to refuse to follow its own policies and procedures pertaining to an appeal process, causing plaintiff to lose their integrity in the community.
The plaintiff requests a trial by jury and seeks judgment for actual and consequential damages in the amount of $5,000, plus punitive damages, attorney's fees, expenses, court costs and other relief. They are represented by Kashaundra G. Gaston of The Gaston Firm in Chicago.
