Former Ditto Trade CEO sues ex-lawyers, accuses them of mishandling motions to contest sanctions

CHICAGO — The former CEO of DItto Holdings is suing his former lawyers at the Ricci Law Firm, citing alleged negligence.

Joseph Fox,, also known as Yosef Fox, filed a complaint on Aug. 10 in Cook County Circuit Court against the defendants, alleging they breached their duty of good faith and fair dealings.

Fox, who was the CEO of Ditto Holdings, alleges his lawyers at the Ricci firm failed to properly convey to a judge information concerning why Fox suspended a deposition amid a legal dispute with former Ditto Trade executive vice president Paul Simons.

Fox has claimed Simons made false accusations against Ditto Trade and its subsidiary, when he learned he was about to be fired. Simons filed a breach of contract suit against Fox and Ditto Trade. Fox then filed a counter claim. 

Fox claimed he had to suspend a deposition in the matter because of an emergency situation at his company involving federal regulators.

Fox asserts Ricci never properly told the judge why he "walked out" of a deposition in the case, leading to the judge entering a motion for sanctions against him. He also has accused Ricci of failing to file motions to reconsider and other motions, including to contest Simons request for $44,000 in attorney fees. 

He accuses Ricci of failing to secure 21 days or any amount of time for plaintiff to obtain new counsel.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount to be determined at trial, plus other relief. He is represented by Gary L. Gassman of Gassman Legal PC in Chicago.
