Business partners accused of fraud and breach of contract following man's death

CHICAGO — The estate of Andrzej Niewolik is suing Niewolik's business partners, citing alleged breach of contract, fraud and unjust enrichment.

Krystyna Niewolik, his widow, is the independent administrator for the estate. The estate filed a complaint on Aug. 23 in Cook County Circuit Court against defendants including A.Z. Properties Inc. and Soap Box Inc., alleging the defendants breached their duty as business partners to provide a clear accounting of the businesses.

Before Andrzej passed away unexpectedly on Nov. 10, 2017, according to court documents, his independent administrator, Krystyna Niewolik, claims he was one-half owner of the businesses with defendants and owned 500 shares of each corporation. 

However, despite his wife's repeated requests of an accounting, documents and information, decedent's estate has not been provided with any meaningful accounting, according to the complaint.

She further claims that the assets and income of the business are being wasted, misapplied, converted or misappropriated for defendants' alleged personal benefit, according to the complaint. 

The plaintiff requests a trial by jury and seeks preliminary injunction, removal of Zdzislaw Kucinski as director, order of the dissolution and sale of the business, and any other relief that the court deems just and fair. The plaintiff is represented by Andrew J. Annes and Tomasz A. Sobieraj of Schenk Annes Tepper Campbell Ltd. in Chicago.
