CHICAGO – A plenary guardian alleges a long-term nursing care facility in Chicago failed to prevent a resident from falling.

Deborah Pitts, as plenary guardian for Ernestine Pitts, filed a complaint on Aug. 31 in Cook County Circuit Court against The Mosaic of Lakeshore, alleging, while in the defendants' care in January 2016, Ernestine Pitts fell and was injured twice.

The plaintiff alleges the defendant failed to protect Ernestine Pitts from abuse and neglect, failed to provide adequate supervision to prevent falls, and failed to train nurses and nursing assistants to meet Ernestine Pitts' needs.

The plaintiff seeks judgment against defendant for more than $50,000, plus attorney fees and costs. She is represented by Kelly Sabo Gaden of The Law Offices of Steven J. Malman in Chicago.
