Man accuses law firm Grant and Grant PC of professional negligence in handling his divorce case

Lawsuits

CHICAGO – A man has sued his former attorneys, saying he "was forced to incur several hundred thousand dollars" in attorney fees because of the alleged negligence of the law firm that handled his divorce.

Michael Callahan filed a complaint on Sept. 4 in Cook County Circuit Court against Burton F. Grant and Grant and Grant PC, alleging professional negligence and breach of fiduciary duty.

According to the complaint, Callahan retained the defendants to represent him in obtaining a divorce in 2007. He alleges the defendants breached their duty by falsely advising the court there was no marital estate to divide, that his retirement plan might be worth $100,000, and that the plaintiff had been awarded the former martial residence. He alleges because of these acts and omissions, his judgment for dissolution of marriage was vacated.

The plaintiff holds Grant and Grant and Grant PC responsible because the defendants allegedly failed to correctly explain to the trial court why the marital settlement agreement was not unconscionable in the divorce proceeding.

The plaintiff seeks judgment for more than $50,000. He is represented by attorney Alan J. Mandel in Skokie.
