Lawsuit dismissed vs Lincolnwood Fund over woman's alleged investment losses

CHICAGO – A lawsuit brought by a woman against her investment managers has been voluntarily dismissed. 

On Dec. 18, Cook County CIrcuit Judge Neil Cohen granted the motion to voluntarily dismiss, with prejudice, the lawsuit brought by Roslyn Sugar. The order instructed both sides to pay their own legal fees.

Sugar had filed a complaint in Cook County Circuit Court against Lincolnwood Fund LP, Lincolnwood Advisors LLC, Bella Heching and David Stern alleging breach of fiduciary duty and other counts.

According to the complaint, the plaintiff alleged that in April 2001, she became a limited partner of the Lincolnwood Fund and agreed to invest several hundred thousand dollars. 

She alleges she lost the majority of her initial capital contribution with no "reasonable explanation" from the defendants. The suit stated in January 2007, her quarterly ending balance reported $608,050 in her account, but by December 2014, the balance was $54,781.63.

The plaintiff is represented by Evan M. Meyers and Jad Sheikali of McGuire Law PC in Chicago.

The defendants are represented by The Law Offices of Edward T. Joyce & Associates, of Chicago.
