Consumers sue XSport Fitness for unsolicited text messages

CHICAGO — Consumers have filed a lawsuit against XSport Fitness, citing alleged violation of the Telephone Consumer Protection Act.

Alaa Abuisneineh filed a complaint on behalf of himself and a class of similarly situated individuals on Aug. 29 in Cook County Circuit Court, against Capital Fitness Inc., doing business as XSport Fitness, alleging the fitness center chain improperly sent unsolicited automated text messages to him and others to entice them to purchase gym memberships.

The plaintiffs alleges XSport failed to honor consumers' requests to stop texting them.

The plaintiffs request a trial by jury and ask the court to certify their lawsuit as a class action, and to award actual and statutory damages, plus attorney fees and further relief. They are represented by Eugene Y. Turin and William P.N. Kingston of McGuire Law PC in Chicago.
