Nursing home sued after resident allegedly falls twice

CHICAGO — A lawsuit has been filed against Alden Lakeland Rehabilitation and Health Care Center, after a resident allegedly fell twice, suffering serious injuries.

Patricia Cagney, as attorney-in-fact for Michael Leonard, filed a complaint on Sept. 5 in Cook County Circuit Court against Alden Lakeland, alleging while Michael Leonard was a resident at the nursing home in 2016, he allegedly suffered two falls, hitting his head. After being transferred to Presence Saint Mary of Nazareth Hospital, he was diagnosed with subdural hematoma, nasal bone fractures, contusions and abrasions to his face, loose front teeth, altered mental status and dehydration. 

The plaintiff alleges the defendants failed to provide the necessary services to attain or maintain resident's highest practicable, physical, mental and psycho-social well-being in accordance with a comprehensive assessment and plan of care.

The plaintiff requests a trial by jury and seeks judgment greater than $50,000. She is represented by Margaret P. Battersby of Levin & Perconti in Chicago.
