Couple accuses doctor of improperly performing penile implant, treating infection

CHICAGO — A Chicago surgeon faces a lawsuit by a couple alleging he improperly performed a penile implant and allowed an infection to develop that caused permanent injuries.

Ramiro and Graciela Reyes filed a complaint on Sept. 7 in Cook County Circuit Court, accusing physician Thomas Malvar and Presence Saint Mary of Nazareth Hospital, and other affiliated defendants,of negligence.

The couple alleged on Sept. 9, 2016, Ramiro Reyes suffered pain and anguish, disability, disfigurement, loss of income, physical and emotional trauma, and medical expenses, as a result of defendants' failure to render an adequate diagnosis, care, treatment and hospital services.

 Additionally, Graciella Reyes alleges she was deprived of the care, services, association, companionship, society and consortium of her husband, the lawsuit claims. 

The plaintiffs allege that Malvar "failed to properly perform an implantation of an inflatable multi-component penile implant with circumcision," and failed to appropriately diagnose, treat and monitor the condition of Ramiro Reyes resulting in an infection that was not treated properly.

The plaintiffs request a trial by jury and seek judgment against defendants greater than $50,000, plus costs of suit. They are represented by Paul G. Toole of Salvato & O'Toole in Chicago.
