Wrongful death suit filed against Fullerton Albany Women's Clinic, physician over stillbirth

CHICAGO – A mother has filed a wrongful death suit against a physician and medical office after her daughter was stillborn.

Aracelia J. Alvarez filed a complaint on Sept. 20 in Cook County Circuit Court against physician Leticia F. Claridad and Fullerton Albany Women's Clinic alleging wrongful death.

According to the complaint, Claridad performed an ultrasound on Oct. 19, 2016, and was unable to obtain a fetal heart tracing, but indicated there was in-utero fetal movement and the ultrasound was normal.

The suit states the next day, the plaintiff went to the emergency room of Presence Saint Mary Hospital due to the lack of in-utero fetal movement and her daughter was stillborn Oct. 21, 2016.

The plaintiff holds Claridad and Fullerton Albany Women's Clinic responsible because the defendants allegedly failed to order necessary diagnostic tests and failed to utilize appropriate interventions to prevent fatal fetal blood flow restriction.

The plaintiff seeks judgment against the defendants in such amount in excess of the court's jurisdictional requisite that will fairly and adequately compensate the plaintiff for the injuries, losses and damages. She is represented by Jennifer K. Scifo and Michael S. Shinsky of Kralovec, Jambois & Schwartz in Chicago.
